Terms and Conditions
This contract outlines the terms and conditions for the photography services provided by Bella's Photography. By signing this agreement, the Client agrees to the following terms:
Payment Methods
Each photographer at Bella’s Photography may have different accepted payment methods. The Client will be informed of the accepted methods for their specific photographer before the session date to avoid confusion. Generally, payments can be made by cash on the day of the session or through an invoice sent via Squarespace, which allows payment via PayPal. A non-refundable deposit of 15% is required to secure the booking, and the remaining balance is due within 7 days after the session. Late payments may incur additional fees of $10 per day.Photo Release Rights
The Client grants Bella's Photography permission to photograph and/or record them during the session. The photos and videos may be used for advertising, marketing, and promotional purposes, including but not limited to social media, websites, and print materials. The Client will not receive any payment for the use of these images. The Client releases Bella's Photography from any claims related to the use of the images and waives the right to inspect or approve the final materials. These rights are permanent and cannot be revoked unless discussed with Bella’s Photography in writing before the session.Additional Charges
Additional charges may apply for:Mileage: A charge of $4.00 for every 10 miles outside a 20-mile radius from Perrysburg, OH.
Extra Time: $1.00 per minute for any time exceeding the scheduled session, charged only after a verbal agreement on the additional time.
Family Sessions: For family sessions, 8 members are included in the session price. Beginning with the 9th person, an additional fee of $10.00 per family member will be applied.
Cancellation and Rescheduling
A. We require at least 12 HOURS advance notice if you are unable to attend your appointment.
B. Same-day cancellations will incur a 50% fee for services booked.
C. No call/no-show appointments will be charged 100% of the scheduled services.
D. A cancellation is only considered valid if you call (419) 740-0891 and speak with a team member or leave a voicemail.
E. Cancellations via email, text message, or social media will not be accepted.
F. Cancellation fees must be paid before you can book your next appointment.
Liability and Insurance
Bella's Photography is not responsible for any injuries or damages that occur during the session. The Client agrees to hold Bella's Photography harmless from any claims, including those related to personal property. Bella’s Photography has insurance for its equipment but encourages clients to have their own insurance if necessary.Force Majeure
Neither party is liable for failing to meet obligations due to events beyond their control, such as natural disasters, pandemics, or other unforeseen circumstances. In such cases, Bella’s Photography may offer to reschedule the session or provide a partial refund at its discretion.Client Responsibilities
The Client agrees to provide all necessary information, such as intake forms and questionnaires, and to be present for the scheduled session. The Client is responsible for their preparation, including clothing, props, cosmetics, hair, and other related items. Failure to do so may result in an incomplete session or additional charges. If the Client arrives more than 15 minutes late, the session may be shortened or canceled without a refund.Photo Delivery Timeline
Photos will be delivered to the Client within 3-4 weeks after the session date. In case of unforeseen delays, Bella's Photography will communicate with the Client promptly.Governing Law and Dispute Resolution
This contract is governed by the laws of Ohio. Any disputes will be resolved through mediation or arbitration in Perrysburg, OH, before pursuing legal action. Both parties agree to make a good-faith effort to resolve disputes amicably before resorting to formal proceedings.Data Protection and Privacy
Bella’s Photography will handle the Client’s personal information in accordance with data protection laws. Information will only be used for the session and stored securely. Photos will be kept for one year after the session; after that, availability is not guaranteed. The Client has the right to request access to their personal data held by Bella's Photography at any time.
